Beginning: What is the housing code?

410.001: Purpose

The purposes of 105 CMR 410.000 are to protect the health, safety and well-being of the occupants of housing and of the general public, to facilitate the use of legal remedies available to occupants of substandard housing, to assist boards of health in their enforcement of this code and to provide a method of notifying interested parties of violations of conditions which require immediate attention.

 

 

410.820 (A): Inspection Upon Request

The call comes in for an inspection.

The board of health is obligated to conduct an inspection.

 
 

410.820 (B): The Log Book

All requests for inspection should be loggied in. Prior to an inspection, it is important to look back at old files on the dwelling as they may be an indication of on going concerns.

   
 

When going out to conduct an inspection always preplan what equipment and forms you may need.

You may need lead paint testing material if there are children under six years of age and you are a licensed lead determinator.

Remember this inspection may end up as a court document so be accurate.

 

 
 

As you approach the dwelling walk directly to the main door to announce your presence. Be observant not only for code violations but to any dangers or environmental hazards that you may expose yourself to (trip hazards, dogs, etc.).

Remember that you cannot walk around private property without permission from the occupant or an administrative search warrant. Always ask for legal advice if you're not sure. Don't end up on a video of you trespassing!
